Conditions for online reservations and individually quoted events

1. Contracting party and scope

Berolina Bowling Strike Inn GmbH, Kleiststraße 3–6, 10787 Berlin, is the provider of the standard reservation and the contracting party for paid bowling and event contracts.

These conditions apply to standard reservations made through the 4bowl online booking system integrated by Berolina and to individually offered events, unless the relevant offer provides otherwise.

Free standard reservations may be made only by persons who have reached the age of 18. The same applies to entering into paid bowling and event contracts. Minors may participate in the reserved or agreed service; however, the reservation or contract must be made by an adult who is authorised to make the required declarations.

Individually negotiated agreements take precedence over these conditions. The separate House Rules also apply to conduct and safety at the venue.

2. Free standard reservation and contract concluded on site

Berolina Bowling Strike Inn GmbH, not 4bowl as the technical provider of the booking system, is the provider of the reservation and the contracting party under any subsequent bowling contract.

The online standard reservation through 4bowl is free of charge. It requires a personal 4bowl account; a reservation cannot be made without an account.

Customers who are already registered sign in with their email address and password. Selecting the final button labelled “Verbindlich buchen” submits the reservation request. In this context, “Verbindlich” refers to the reservation of a lane subsequently confirmed by Berolina, not to the conclusion of a paid bowling contract.

New customers first enter the registration details required by 4bowl, confirm the data-use statement required in the system in accordance with the 4bowl privacy policy linked there, and select the button labelled “Registrieren”. 4bowl then sends an activation email. If the relevant confirmation has not yet been stored for the account, the activation page may additionally ask the customer to confirm 4bowl’s terms and conditions and the data-use statement and to select “Account aktivieren”. The reservation becomes effective and is transmitted to Berolina only if the account is successfully activated through the link in that email before the reservation window applicable to the selected time expires. If activation is not completed within that window, no reservation is made.

After successful transmission, 4bowl sends the booking confirmation by email; no additional manual confirmation is planned.

The confirmed standard reservation requires Berolina to keep a suitable lane available to the confirmed extent until the holding period specified in section 5 expires. It does not require the person making the reservation to attend, use or pay for any bowling or other service. No reservation, cancellation, processing or no-show fee is charged for the reservation itself.

A paid bowling contract is not concluded online, but only on site. Before the contract is concluded, Berolina informs the customer of the total price including VAT and the price of any selected additional services. The contract is concluded only when the customer accepts and pays for the services offered in this way. A payment obligation arises only at that point.

In this process, the term “Buchungsbestätigung” used by 4bowl refers solely to confirmation of the free standard reservation; it is not confirmation of a paid bowling contract.

2.1 Technical steps, reservation text and language

The online reservation involves selecting the booking category, date, duration, number of persons and lanes, and desired services; entering or confirming the required contact details; and reviewing the final reservation summary. A 4bowl account is required for final submission: customers who are already registered sign in with their email address and password and select “Verbindlich buchen”. New customers register an account, including the data-use confirmation required in the system, and must then activate it successfully through the activation email. Before selecting the relevant final button, entries can be corrected using the back, change and correction options offered by the booking system.

Berolina stores the reservation data transmitted by 4bowl for the purposes and according to the retention criteria described in the Privacy Policy. After the reservation has been completed, Berolina does not provide a permanently accessible online archive of the full reservation text. The reservation confirmation is sent by email. The Booking Conditions and House Rules applicable at the time can be saved and printed before the reservation is made.

The 4bowl booking interface currently offers German, English, French and Norwegian as selectable interface languages. Berolina currently provides these Booking Conditions and the House Rules in German and English. The paid bowling contract is concluded on site.

Berolina has not subscribed to a code of conduct within the meaning of Art. 246c no. 5 EGBGB.

3. Reserved time and price information

The reservation summary and confirmation email specify the scope of the free standard reservation. In particular, they may contain the following information:

The price and service information published for the selected category when the reservation is made forms the basis of the price offered on site. Before the paid bowling contract is concluded, Berolina states the specific total price including VAT. Optional additional services are charged only if the customer selects them. The price information and reservation do not in themselves create a payment obligation.

  • booking category;
  • date, start time and duration;
  • number of persons and lanes;
  • clearly identified intended services.

3.1 Lane assignment and shoes

A maximum of six players is intended per lane. There is no entitlement to a particular lane. Berolina may assign a lane suitable for the reserved service.

The published service description states whether rental shoes are included in the selected category. If they are not included, they can be rented on site as an option at the price stated before the contract is concluded. Suitable personal bowling shoes may be used.

3.2 Optional birthday greeting with a photo

If a children’s birthday package includes a personal greeting on the screen, Berolina can take the photo used for it at the reception desk on site. Staff do not ask guests for this on their own initiative. The photo greeting is provided only if the birthday person, or, where the birthday person is a minor, an attending person with parental responsibility who is authorised to make this decision, requests it on their own initiative and gives oral consent. An adult birthday person must give oral consent personally. Any clearly expressed objection by the person shown in the photo is always respected.

The photo is processed solely for immediate display on the screen at the lane assigned to the party; the screen may be visible to other guests present. The photo is neither transmitted in advance nor stored as an image file or copied to an inbox, work queue, cloud service, backup or other archive. It is not published online, used for advertising or used for other events. After the display has ended, the photo is no longer available to Berolina. Further details, particularly about consent and withdrawal, are provided in the Privacy Policy.

4. Paid contract concluded on site and period of use

No payment is taken through the online booking system. On site, Berolina first states the total price. If the customer accepts the offer, payment is made at the till before the lane is activated and any rental shoes are issued. Payment can be made in cash or by a card accepted on site.

The agreed charge relates to the duration agreed when the contract is concluded on site. If the customer voluntarily stops bowling earlier, this does not reduce the agreed charge. Statutory rights in the event of a disruption to performance for which Berolina is responsible remain unaffected.

An extension is possible only if there is corresponding availability. It is agreed separately on site in the offered increments of 15 minutes. Extensions granted as a gesture of goodwill do not create an entitlement for subsequent bookings.

5. Arrival, delay and release of the lane

Customers should report to the reception desk in good time before the confirmed start time so that conclusion of the contract, payment, changing shoes and lane assignment can take place without delay.

As a rule, the lane is held for the person who made the reservation for ten minutes from the confirmed start time. If that person arrives late, decides to use the service and concludes a paid contract on site, the confirmed end time remains decisive; the playing time actually available may therefore be shorter.

After ten minutes, Berolina may assign the lane to someone else depending on current capacity. Venue management may hold the lane for longer in an individual case. This does not create an entitlement to an extension or to the same goodwill in a later case.

If the person who made the reservation does not use the standard reservation and the lane is released after the holding period, the reservation ends without charge. Non-use alone creates neither a payment obligation nor a cancellation, processing or no-show fee.

6. Changing and cancelling a standard reservation

If a reservation cannot be used, it should be cancelled as early as possible.

Online self-cancellation is available through the link in the confirmation email until 15 minutes before the confirmed start time. This is the technical deadline for self-cancellation. No cancellation or processing fee is charged for self-cancellation.

If online self-cancellation is no longer available, the cancellation can be notified during opening hours using the main telephone number stated on the website. No cancellation or processing fee is charged for cancellation by telephone either.

Even if no cancellation is notified, non-use alone does not incur a charge; section 5 applies.

7. Free relinquishment of a standard reservation and right of withdrawal for events

The free standard reservation can be cancelled without charge in accordance with section 6 and may also be left unused without any resulting charge.

Where section 312g(2) no. 9 BGB applies, there is generally no statutory right of withdrawal for a paid event contract concerning leisure services to be provided on a specific date or during a specific period. Any statutory or contractually agreed rights in the event of cancellation remain unaffected.

8. Operational and equipment failures

Technical problems must be reported to staff immediately. Berolina may first offer another suitable lane, continuation after the problem has been resolved, or another reasonable solution.

Technical problems and machine failures are not treated across the board as force majeure. Statutory claims where a service is not provided or is not provided in accordance with the contract are not excluded.

9. Event enquiries and event contract

Submitting the event form on the website is non-binding. It neither reserves a date nor concludes an event contract. Discussions before the final offer are also non-binding unless Berolina expressly states otherwise.

Once the details have been agreed, Berolina sends a complete offer that is open for a limited period. In particular, it specifies the scope of services, date, number of persons or billing basis, total price, payment schedule, method and deadline for acceptance, any acceptance payment and its payment-receipt deadline, incorporated conditions, and confirmed special requirements.

If the offer provides for an acceptance payment, it is accepted when that payment is received by Berolina within the specified period. The event contract and the reservation are concluded upon receipt. From that point, the acceptance payment is credited as a deposit towards the total price. Berolina then sends a booking confirmation for the customer’s records; this is not an additional acceptance or contract-formation step.

If, exceptionally, an offer does not provide for an acceptance payment, the contract is concluded through the express and timely acceptance in text form required by the offer.

10. Number of persons and changes to event services

The number of persons stated in a non-binding enquiry is initially used for planning. The number of persons shown in the final offer becomes the binding number for billing when the contract is concluded or, where an acceptance payment is required, when that payment is received by Berolina on time. If fewer people actually attend, the binding number for billing remains decisive unless Berolina expressly agrees to a reduction in text form.

Changes to the number of persons or to other services are effective only after express confirmation by Berolina in text form and are subject to availability. Venue management may allow changes on the day of the event at its discretion; they are not guaranteed. Any minimum number of persons applying to the particular event is stated in the individual offer.

Additional services, exclusive use of an event room and other special requirements apply only if they were confirmed in the individual offer or in a subsequent addition in text form.

11. Deposits, final payment and cancellation of an event

If the offer requires an acceptance payment, it states the amount, the payment-receipt deadline, the bank details and the significance of timely receipt for conclusion of the contract. When the contract is concluded, the amount received is credited as a deposit towards the total price. The offer states the amount or calculation, due date and payment method for the final payment.

If the customer cancels a contractually confirmed event, any remaining payment or remuneration claim by Berolina is governed by the applicable statutory rules or any valid rules individually agreed. Expenses saved and possible alternative use or reallocation are taken into account. A deposit is not forfeited automatically.

The deposit is set off only against the payment or remuneration claim that actually remains after this calculation. Berolina refunds any amount exceeding that claim. If Berolina cannot provide the confirmed event in accordance with the contract, statutory refund and other rights remain unaffected.

If a confirmed event cannot take place at all because of an occurrence for which neither contracting party is responsible, the customer can choose between rebooking and a full refund of the payments made for the event, including the deposit.

12. House Rules

The House Rules are available on the Berolina website. In particular, they govern safety, suitable bowling shoes, supervision of children, conduct at the venue and handling of facilities. They become part of a contract only where Berolina has effectively drawn attention to them before the contract is concluded and has provided a reasonable opportunity to review them.

13. Privacy

The Privacy Policy, these conditions and the House Rules are available on the Berolina website. Acknowledging the Privacy Policy does not constitute consent under data protection law.

14. Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.
